    Personal Data Policy

    Markpak Ltd. ("The Company") has established this Personal Data Policy Announcement to inform customers of our products and services, including prospective customers, users, and visitors ("You" or "Customer"), about the company's policy regarding the collection, use, and disclosure of personal data, in accordance with the Personal Data Protection Act B.E. 2562 ("PDPA"), laws, and related regulations. This Personal Data Policy will inform you about how the company collects, uses, or discloses your personal data, the types of data, and the purposes of such actions, including details on the retention period, disclosure of personal data to external parties, your rights, the confidentiality and security of your personal data, and how you can contact the company.

    1. Definition of Personal Data "Personal Data" means data about an individual that can identify that individual either directly or indirectly, in accordance with applicable laws.

    2. Collection of Personal Data 2.1 Personal Data Collected The company collects your personal data and various information as follows:

    • Name, Surname
    • Address
    • Email
    • Phone number
    • Social media contact information (e.g., LINE ID, Facebook ID)
    • Other personal data you have provided to the company 2.2 Method of Collecting Personal Data The company will collect your personal data through various channels directly from you or through the company's website www.markpak.com, other company websites, or from other sources not directly from you, such as from other organizations or security service providers, social media platforms, etc. 2.3 Duration of Personal Data Retention The company will collect your personal data for the purposes stated for as long as you remain a customer of the company and will continue to store and use it for 10 years after you cease to be a customer of the company, as necessary for the purposes of collecting personal data or as required by law.
    1. Purposes of Collecting Personal Data The company will collect, use, and/or disclose such information, including your personal data, as necessary for the lawful benefit of the company or with your consent or for other lawful reasons, as necessary for the following purposes:
    • For use, including for the administration and management of your data in the company's marketing activities as per the terms and conditions of each participation.
    • To provide information, advice, publicity about products, services, or marketing activities through channels you have provided, including for the presentation of the company's products and services.
    • To develop products and services, as well as sales promotion and marketing activities of the company.
    • To communicate, respond, and assist you, including for after-sales service.
    • To verify your identity before providing services to you.

    • To provide services and/or for contact, communication, mailing of parcels such as inquiries about satisfaction with the company's products and services, notification of promotional activities, or special discounts.

    • To prevent or suppress harm to life, body, or health of a person. If you do not provide your personal data to the company, the company may not be able to serve you in some cases.
    1. Protection of Personal Data The company will keep your personal data securely according to technical measures and administrative management measures to maintain appropriate data security and to prevent personal data breach, loss, unauthorized access, destruction, use, alteration, unauthorized disclosure, or use outside the purposes or without authority. You have the freedom to give consent for the company to collect, use, or disclose your personal data. The company will not set consent conditions to access services or enter into contracts with the company if the personal data is not necessary or related to the contract or service. Furthermore, the company has mandated that employees, personnel, representatives, and data recipients from the company have the duty to keep your personal data confidential and secure according to the measures set by the company when having to perform any actions with your personal data. If you, the owner of the personal data, are a minor according to the Civil and Commercial Code, your consent must be obtained from your legal guardian. If the person giving consent is a minor under 10 years old, consent must be directly obtained from the legal guardian. If you, the owner of the personal data, are an incompetent person or quasi-incompetent person, consent must be obtained from the custodian or guardian authorized to act on behalf of the incompetent or quasi-incompetent person as applicable. The company will ensure that your information is accurate, current, complete, and does not cause misunderstanding.

    2. Disclosure of Personal Data 5.1 Types of Personal Data Recipients In conducting business, the company needs to disclose necessary personal data to various service providers and business partners of the company, such as for marketing data analysis services, product transportation services, security development, application development, promotional event organization, communication, mailing of parcels, and other disclosures according to the purposes of using the data as stated in section 3. 5.2 Transferring or Sending Personal Data Abroad In some cases, the company transfers the stored data to the company's database on computers located abroad, operated and managed by the company's foreign partners, which have adequate personal data protection standards, in accordance with Thai personal data protection laws. These data will be strictly secured.

    3. Rights of Personal Data Owners You have the following rights under the general personal data protection law of Thailand:

    • You can withdraw consent by contacting the channels provided by the company as stated in section 8. The company notes that if you withdraw your consent, you may lose the right to receive information or benefits, including contact from the company for special rights and activities.
    • You can request access to, obtain a copy of, correct or update your personal data under the company's responsibility to be accurate, current, complete, and not misleading.
    • You can request disclosure of how your personal data was obtained that you did not consent to.
    • You have the right to receive or request the company to send or transfer your personal data to another personal data controller.
    • You can object to the collection, use, or disclosure of personal data, or suspend the use of personal data in certain cases as specified by law.
    • You can request the company to delete, destroy, or anonymize personal data in certain cases as specified by law.
    • You can file a complaint with the competent government agency.
    1. Use of Cookies
    • "Cookies" are small computer data sent to be stored in the user's browser to collect data from website visits to improve the website and service quality.
    • The company will store cookies or similar technologies to improve the performance of the platform and access to the company's services through the internet, to be used for the following cases: a. To allow you to continuously and securely log into your account on the company's platform. b. To store data on your platform usage, including the platform settings you have configured. c. Cookie Settings and Rejection You can choose to reject the operation of cookies according to your preferences by setting your browser or your privacy settings to suspend future data collection by cookies. However, if you set your browser or privacy settings to reject all cookies, you may not be able to use some or all functions on the company's website effectively.     2. Updates to the Personal Data Policy The company reserves the right to amend and update this Personal Data Policy. The company will notify you of such amendments and changes. Additionally, the company may inform you of further details about your personal data beyond this policy, such as the purposes of collecting your personal data, in cases beyond this policy. Any amendments or changes to this Personal Data Policy or any other details about personal data policy will become effective immediately after the company notifies you in a manner deemed appropriate by the company, unless in cases where the company must obtain your consent according to the law, in which case the amendments or changes to this Personal Data Policy or any other details related to the personal data policy will become effective once the company has received your consent.
